PESTICIDE USE ON THE RESERVATION

The Stockbridge-Munsee Tribe strives to maintain a pure and natural environment, however there are times that well made chemicals may have to be used to control some of the invasive species on the reservation.
The Environmental Department is in the process of drafting a tribal regulation concerning the use of pesticides within the reservation. The following draft, not yet approved by the tribal council, references a pesticide approval protocol that is a 14-step process for pesticide approval for use. Any pesticide that does not get approved by this process will not be used on the reservation. This approval protocol insures that the pesticide will not harm the environment, the persons using it, and will not bio-accumulate, it will not leave poisonous by-products in the waters or soil, and will cause minimal damage to non-target species. The people of the Stockbridge-Munsee Community,
in order to safe-guard the health and welfare of the people,
animals and plants of the reservation,
do hereby adopt the following regulation concerning
the application of pesticides approved for use
within the lands under their jurisdiction.
The following procedure details the steps that must be taken in order to use pesticides approved for use on the Stockbridge-Munsee Indian reservation thought the Pesticide Review Protocol as adopted by the Tribe.
| WHAT IS A PESTICIDE? |
Any chemical that causes death to any plant or animal.
Any solid, liquid or gaseous chemical that combines with or causes a chemical action resulting in modification of normal life processes within any plant or animal.
| WHO MUST OBTAIN A PERMIT TO USE PESTICIDES ON THE RESERVATION? |
All Tribal Departments or Businesses.
All Tribal members.
All private enterprises who have utility or transportation right of ways through the reservation.
| WHERE IS PESTICIDE USE REGULATED? |
In all commercial applications of pesticide.
In all applications of pesticides sprayed from a motorized vehicle, be it an airplane, boat or land vehicle.
In all applications beyond normal house hold use.
In all applications applied greater than one half of an acre of private lawn or garden.
In all applications of any size in land designated to be forestry, agriculture, or conservancy.
In all applications in wetlands or adjacent to surface water or within 300 feet of wetlands or surface waters regardless of the size of the area.
| HOW MAY PESTICIDES BE APPLIED ON THE RESERVATION? |
Only pesticides approved by the Tribal Pesticide Review Process may be used on the reservation.
Each time a pesticide is proposed for used on the reservation a Pesticide Application Form must be submitted to the Tribal Environmental Department. This form is attached to this document. Each time the pesticide is used a new form must be submitted to the department.
Only persons holding a valid and current pesticide applicator license (Federal or Wisconsin regulations) may apply pesticides in commercial application or by motorized method.
If the proposed pesticide has been approved through the pesticide review process, the attached form must be submitted to the Environmental Department for approval at least two weeks ahead of time. More time is encouraged.
If the proposed pesticide has not been approved through the pesticide review process, the attached form must be submitted no later than six months before the proposed application. (If the applicator wishes to have a certified or tribally approved laboratory or chemist subject the proposed pesticide to the pesticide review process, and submit the results to the Tribe with the application, a one month lead time will be required).
The Tribal Environmental Department will try to get the approval or rejection of the application to the applicant at least one week before proposed use. We understand that often a number of months lead time is needed to have licensed applicators under contract, thus applications submitted months ahead of time in preparation for approval and contracting will be given consideration and we will try to work within the needed time frame of your project.
